Termination by agreement entailing waiver of the right to unilateral termination
Where the employment contract has been terminated by either party exercising its right to unilateral termination, the subsequent signing of a contractual termination agreement constitutes a joint waiver of the termination previously agreed. Pursuant to article L. 1237-14, paragraph 4, of the French Employment Code, an appeal against the termination agreement must be lodged, on pain of inadmissibility, before the expiry of a period of twelve months from the date of approval of the agreement.
